Our Real Estate team acts as Austrian counsel for the largest owner, developer and manager of designer outlets in Europe. In addition to providing tenant law support for the approximately 290 stores in Austria, our firm provides ongoing advice on insolvency law, construction and commercial law, competition law and data protection matters.

In the wake of the Covid-19 pandemic, our firm assisted in the drafting, negotiation and execution of relief packages with numerous store operators, ranging from large international fashion chains to smaller local stores.

Retail & Concessions

Pitkowitz & Partners is representing a multi-national solar energy corporation with its headquarters in China. The team is advising this client as lead counsel in multi-jurisdictional litigation and arbitrations. These cases stem from a joint venture dispute with a business partner in relation to several solar power plants as well as disputes regarding related services and deliveries of goods. We have been successful in securing several major victories for our client, including a full victory before the Austrian Supreme Court which recognizes a strongly-disputed CIETAC award. The award was rendered during the CIETAC’s Shanghai Commission separation. Pitkowitz & Partners also acted as lead counsel for parallel arbitration and litigation proceedings in Germany and Eastern Europe.

Joint Venture and Post M&A

The Real Estate and Dispute Resolution team of Pitkowitz & Partners represented a US-based manufacturing company in private and public law disputes relating to the shutdown of an approximately 100,000m² manufacturing facility in Austria that had been in operation for many decades. The team also advised the company in several court proceedings pending with the landowner regarding this property, handled the regulatory proceedings and advised on the leasing and commercial approval of a new production site.

The Real Estate team of Pitkowitz & Partners advises one of Austria's leading real estate developers on the sale of an interest in two retail parks to a German investment fund. Our extensive experience with special requirements of foreign investment fund investors combined with local market knowledge is of particular benefit to the client in this case.

Retail & Concessions

The Real Estate team of Pitkowitz & Partners advises a real estate developer on various projects related to the hospitality industry. The team supported the development and sale of a hotel property in Vienna, accompanied the conclusion of the lease agreement with an international hotel chain and the sale of the project to funds. The team also assists other hotel development projects in Salzburg and Linz with the purchase of the property, negotiations with international hotel chains and with building and commercial law proceedings.

Pitkowitz & Partners advises various companies in the fashion industry. One of our core clients is a German-based fashion company that operates over 1,000 stores across Europe. The Real Estate team led by Dr. Martin Foerster is acting as lead counsel in a number of multi-million-dollar landlord and tenant disputes involving several of the client's top locations. This also includes disputes in connection with shopping centers in Vienna and further Austrian cities. In addition, our firm represents a leading Italian fashion group in its market entry into Austria and ongoing expansion.

Retail & Concessions

Our Real Estate Team advised one of Austria's largest owners of apartments and premises in connection with the development of large-scale residential projects, including aspects of subsidy law as well as urban development agreements with the City of Vienna. Another focus of the team is the redevelopment of large apartment buildings and related tenant disputes.

Residential Leases

The Real Estate team of Pitkowitz & Partners has advised on a large number of real estate transactions in all asset classes. Most recently, the team advised on an acquisition of a real estate site in an inner-city location in Vienna for the purpose of constructing residential buildings, on the sale of a commercial property in the city of Salzburg, and on an ongoing basis on apartment building transactions.
